Terms of Service

Last updated:

These Terms of Service ("Terms") govern your use of VelocityStack at velocity-stack.app ("the Service"), operated by Jan Kolář, an individual ("we", "us"). Our Privacy Policy explains how we handle personal data and forms part of these Terms.

Draft notice: this text is a draft prepared for the operator and is not legal advice; it should be reviewed before being relied on.

1. Acceptance

By creating an account, signing in (including with Google) or otherwise using the Service you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

2. The Service

VelocityStack is a training analysis platform for riders, mainly track cyclists. It lets you import or upload rides, analyse power, heart rate and other telemetry, run templates, keep records, plan workouts and races, follow other riders and optionally work with a coach. The Service is provided free of charge and in development ("beta"); features can change or be removed.

3. Eligibility

You must be at least 16 years old, and able to enter a binding agreement where you live, to use the Service. If you use it for an organisation, you confirm you may bind it.

4. Your account

  • Give accurate information and keep your sign-in details secure. You are responsible for all activity under your account.
  • One person, one account. Tell us promptly at koli440@gmail.com if you suspect unauthorised use.
  • We may refuse or remove accounts that break these Terms.

5. Your content and our licence

"Your content" means the data and material you upload, import or create: ride files, metrics, profile, notes, comments, photos, templates and similar. You keep ownership of it.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, analyse, display and transmit your content only as needed to operate, secure and improve the Service and to provide the features you use, including showing it to the riders and coaches you choose or who are permitted by the Service's sharing rules. The licence ends when your content or account is deleted, except for copies kept in routine backups for a limited time.

You confirm that you have the rights to your content and that it does not infringe anyone's rights or break the law. You are responsible for what you share with other riders.

6. Acceptable use

You agree not to:

  • break the law or infringe the rights of others, or post unlawful, abusive, harassing, hateful or misleading content;
  • access data of other users without permission, or try to bypass privacy zones, access controls or rate limits;
  • attempt to probe, disrupt, overload, reverse engineer or attack the Service or its infrastructure;
  • scrape or bulk-download the Service, or use automated means to create accounts or content;
  • upload malware or content you are not allowed to share;
  • misuse the integrations or use the Service to violate the terms of Strava, Intervals.icu, Google or other providers.

We may remove content and suspend or terminate accounts that break these rules.

7. Coaching

  • Coaching on VelocityStack is a relationship between a rider and a coach who are both users. We are not a party to it and do not employ, vet or endorse coaches.
  • A coaching relationship needs the rider's explicit acceptance, and the rider can end it or block the coach at any time. See the Privacy Policy for exactly what a coach can see and change.
  • Coaches must use the athlete's data only to coach that athlete, keep it confidential, make changes only in the athlete's interest and in line with what has been agreed, and follow applicable law. Coach edits are labelled and recorded.
  • Riders decide whether to accept coaching and remain responsible for their own training decisions.
  • Any commercial terms between a coach and a rider are theirs alone.

8. Not medical advice; training at your own risk

The Service provides analytics and planning tools. It is not medical advice and not a substitute for a doctor, physiotherapist or qualified professional. Heart rate, thresholds, zones, load and any suggestions are estimates that can be wrong. Cycling and training carry a risk of injury. You train and race at your own risk and should consult a professional before starting or changing a training programme or if you have a health concern.

9. Integrations and third-party services

You may connect third-party services such as Strava and Intervals.icu, and you can sign in with Google. Those services are governed by their own terms and privacy policies, and your use of them is at your own responsibility. We are not responsible for their availability, changes or data. If you disconnect or the provider ends access, syncing stops, and rides already imported remain in your account. You authorise us to access and import data from them on your behalf as you configure.

10. Intellectual property

The Service, its software, design, text and the VelocityStack name and logo belong to us or our licensors and are protected by law. We give you a limited, personal, revocable, non-transferable right to use the Service under these Terms. Feedback you send may be used by us to improve the Service without obligation to you. Map data is © OpenStreetMap contributors and its providers' licences apply.

11. Availability and no warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free or that data will never be lost, and we may change, suspend or discontinue features at any time. Keep your own copies of important files.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, or for injury or loss arising from your training, from coach advice or from third-party services. Where liability cannot be excluded, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the previous 12 months (which is zero for a free service) or EUR 100. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, for fraud, or your statutory consumer rights.

13. Termination

You can stop using the Service at any time and ask us to delete your account as described in the Privacy Policy. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service, where reasonable with notice. Sections that by their nature should survive termination (such as intellectual property, disclaimers, liability and governing law) survive.

14. Changes

We may update these Terms. The "Last updated" date shows the latest version. If a change is significant we will tell you in the app or by email in advance where required. Continuing to use the Service after changes take effect means you accept them; if you do not, stop using the Service and delete your account.

15. Governing law

These Terms are governed by the laws of the Czech Republic, and the courts of the Czech Republic have jurisdiction, without affecting any mandatory consumer protection rights you have in the country where you live.
